General terms and conditions
Before confirming your reservation, please read the following conditions carefully.
Salome Gomez Baena is a company registered in Spain with NIF 25710174S that operates under the commercial name of "waterfrontmalaga", then "the Company".
The prices shown on our website www.waterfrontmalaga.com are for housing and night or week whenever indicated. All prices are expressed in euros. The prices include all applicable taxes. Our prices may change at any time without being applicable to reservations already confirmed, except for the modification of legal or regulatory taxes established by the competent authorities. The prices include the cleaning of the property before and after the arrival of the client, all the bedding, the maintenance of the property, the expenses of water, electricity, gas and internet if there were and a customer service on time commercial (from 09:00 to 20:30) and emergencies 24 hours a day (by calling 670686469). In case you need additional services such as the rental of a parking space, an additional cleaning during your stay, a cot, a high chair etc, please contact us.
Terms of the reservation procedure
Once you have made a reservation at one of our properties, you will receive a written confirmation confirming the dates and the price of the apartment you have booked, the payment terms and any additional services you have purchased. You will receive directions on how to get to the property where a person from our staff will be waiting to give you the keys, show you the apartment and answer any questions you may have.
To be able to reserve a property, it is necessary to pay a non-refundable reservation fee. This payment formalizes the contractual relationship between the client and Salome Gomez Baena (watefrontmalaga).
Conditions of management expenses
• The reservation payment corresponds to 40 or 80% of the total price of the reservation, depending on the property
• Once the payment is made, this reservation fee is not refundable (see our cancellation policy)
• The remaining balance will be automatically deducted from the card used to make the reservation fee within 30 days prior to arrival. In case your arrival date is within 30 days, the total rental price will be deducted at the time of confirmation. If you require special payment terms, please contact us.
• If you booked your apartment through an external provider (for example Airbnb, Booking.com, HomeAway etc), please note that you will be bound by the terms and conditions of the external providers, both in terms of payment , change of reservation and cancellation.
As a general rule, we can not change a reservation once it has been confirmed. However, in case you need to change a reservation, please inform us as soon as possible, by contacting us via email firstname.lastname@example.org We will do our best to help you in the best possible way.
Cancellations must be communicated in writing and justified to our office (email@example.com) with the following management costs (50 eur) for cancellation:
* More than 60 days before the arrival date: 100% Rent refund, full loss of management expenses 50 eur.
* 60-31 days before the arrival date: 75% loss of the total rental price.
* 30 days or less before arrival: 100% loss of the total rental price
* More than 120 days before the arrival date: 100% Rent refund, full loss of management expenses 50 eur.
* 120-61 days before the arrival date: 75% loss of the total rental price.
* 60 days or less before arrival: 100% loss of the total rental price
If, due to circumstances beyond our control, the booked apartment is not available for occupancy, the Company reserves the right to relocate it to an alternative accommodation, with similar characteristics, at no additional cost. If for any reason we are unable to transfer you or offer an alternative accommodation, the reservation will be canceled and a full refund will be made.
In the event that the reservation is canceled due to causes attributable to the client, the amount paid as a management fee will not be reimbursed. However, in some situations, the amount paid may be used at a later date for a reservation on the same property. This credit will be valid 6 months from the date of issue.
Entrance to the house
The arrival and departure times may vary depending on the apartment you have booked, but as a general rule, the arrival time is at 16:00 on the day indicated in your booking confirmation, regardless of your arrival time in Malaga.
We always do everything possible to reduce waiting times. In case the property is available ahead of time, we will do everything possible so you can enter as soon as possible. In the event of changes in your travel plans, unforeseen events or any change in your arrival time to Malaga, please inform us as soon as possible.

Upon arrival, you must complete and sign a lease agreement with the owner's manager of the property as well as a form for the National Police, including your surnames, first name, ID number, etc.). This procedure is mandatory for anyone over 16 years of age in accordance with Spanish legislation. Anyone who refuses to comply with this procedure will not be able to access the property.
Please note that there will be a surcharge for arrivals outside of business hours of € 30 for arrivals between 20:00 and 22:00. After 22:00 the surcharge will be € 50. This amount must be paid in cash upon arrival.
Exit of the house
As a general rule, the departure time of the apartment and the return of the keys will be made before 11:00 on the last day that appears on your booking confirmation sheet. At the request of the client and always upon request the availability of the company, the time of the departure of the house can be extended. For example, if you need additional time in the apartment because your flight is late, we will do our best to respond favorably to your request.
Cleaning, bed linen and towels
The house is completely cleaned before and after each new guest. In case you need additional cleaning during longer stays, we can arrange it for an additional cost.
A final cleaning is included in the price; however, our rules are to leave the property in the best possible conditions, take out the garbage, wash the dishes and all utensils, as a courtesy to our cleaning staff and future customers, do not bring sand or stones from the beach.
We provide a large towel (140x70cm) and a medium size towel (100x50cm) per person. In case you need more towels during your stay, they are available at the price of € 5 per unit.
Services and special requirements
Our purpose is to satisfy all those needs that our clients may require during their stay in one of our homes. So if you require any extra service or have any special requirement, please inform us and at waterfrontmalaga we will do everything in our power to satisfy all your demands.
People with some type of motor disability
Unfortunately in waterfrontmalaga we regret to inform you that currently we do not have any housing specifically adapted for people with some type of motor disability. However, we have easily accessible homes built on the same level and that may be suitable for these people. If you require more information, do not hesitate to contact us and we will be happy to help you.
Number of occupants
The maximum number of occupants of a dwelling is that which is established in the descriptions of the dwellings in accordance with the current law of the Autonomous Community of Andalusia. Therefore, it is not allowed to use the house for a number of occupants higher than the one shown on the booking confirmation sheet. Failure to comply with this rule may be grounds for termination of the contract by the company, reserving the right, if it sees fit, to leave the occupants unconfirmed in the reserve, or all its occupants, if this situation resulted in behavioral problems, complaints from neighbors, or a disrespectful use of housing. If you have any doubts or questions regarding the maximum number of occupants, let us know and we will be happy to help you.
At waterfrontmalaga we hope that our clients enjoy their stay with us to the maximum, but always having a respectful and civic behavior, both with the house and with the neighbors. The client is responsible for his own behavior as well as that of his companions. If for any reason there is any complaint, demand or complaint by the neighbors or by the competent authority for the conduct of one or more occupants for whatever reason, it can not proceed to the immediate abandonment of the person's home. causing problems or all its members if deemed appropriate, without the right to any refund of the cost of your reservation. In addition, without prejudice to all of the above, if there were any damage or breakage in the home, it would be paid with the deposit of the deposit and the judicial remedy would be appealed if the company considered it appropriate.

As a general rule, we kindly ask you the following:

No noise in the apartment, terrace or common areas after 9:00 p.m.

Do not organize parties or noisy celebrations in the apartment
Do not carry out any illegal activity in the apartment
No smoking inside the property
Do not enter with pets inside the property
The owner of the property (or watefrontmalaga in his name) has the right to expel any guest who does not respect the property rules without refund none

watefrontmalaga is not responsible for the noise generated by works on the street, road works or works of neighbors, construction of buildings and other annoyances caused by external factors
watefrontmalaga is not responsible in case a property is not available due to force majeure
We inform you that, as a general rule of the company, pets are not allowed in our homes. Only those cases in which the animal is shown to be of assistance are allowed, always with the prior authorization of the owner of the house, so we ask that if this is the case, contact us to make possible and make the stay as easy as possible. Except for these cases, the breach of this rule will be grounds for not terminating the holiday contract, and suppose the immediate abandonment of the property without the right to refund the costs of the reservation.
If you have any kind of complaint during your stay, please let us know as soon as possible, since watefrontmalaga will not accept any claim made at a later date than your stay in any of our homes. In watefrontmalaga we will do everything in our power to solve the possible claims that may arise in the most efficient way possible. In addition, we inform you that we have claim sheets available to our customers. We have at your disposal sheets of claims of the Junta de Andalucía.
The properties that watefrontmalaga manages require a deposit of deposit, which will be paid in cash (or by credit card) before entering the house or together with the last payment of the cost of your reservation. The bond deposit is returnable and will be repaid 24 hours after departure, as long as during your inspection there is no anomaly, breakage or damage to the property, furniture, appliances and other elements that make it up. If not, watefrontmalaga reserves the right to use part or all of the deposit to cover the costs of possible repairs or replacements that have to face. The security deposit or deposit is different in all the properties, but generally it is between € 200 and € 450.
Change of housing
Only in case of force majeure, error of third parties or any anomaly or damage to the reserved home, watefrontmalaga accepts the right to change the house for another of the same category or higher than that reserved with the approval of the client, or to proceed with the return of the total cost of the reservation.
watefrontmalaga is not responsible for loss or loss of luggage, theft, damage or other accidents unrelated to the management of the company. The client declares that he will make proper use of the leased property, exempting watefrontmalaga from any liability, as well as that the client will take care of the damages caused in a premeditated way or by a misuse in the property. watefrontmalaga reserves the right to update any of these conditions at any time in case it is required in accordance with the company's own activity.
Protection of personal data of users by Watefrontmalaga
In accordance with the Organic Law 15/1999, of Protection of Personal Data, the Client is informed of the incorporation of their data into a file, which is responsible for Salome Gomez Baena (hereinafter the Company), and whose purpose is the management of the client's accommodation. It may be used, as long as the client has expressly indicated it, to inform about related services, offers and commercial campaigns. The user of online booking services is voluntarily providing personal data (from now on, Personal Data) whose sole purpose is to supplement the reservation. The card data is either made in a payment gateway belonging to the bank with which the company has contracted the service, or it is carried out in a secure environment, in which case the Company will not know such data. The customer can exercise the rights of access, opposition, rectification and cancellation of their data, by writing to the Company, calle superficial, 10, right, 1st right, 29001 Málaga. The Company guarantees that they have adopted the appropriate security measures in their facilities, systems and files. The users of the online reservation system guarantee and respond, in any case, of the veracity, accuracy, validity and authenticity of the Personal Data provided, and undertake to keep them duly updated.
Applicable law and competent jurisdiction
These terms and / or general conditions of contract are governed by Spanish Law. Salome Gomez Baena. and users, for the resolution of any dispute that may arise, with respect to its validity, execution, compliance or resolution, total or partial, are submitted, expressly waiving their own jurisdiction or any other that, if applicable, may correspond to the jurisdiction of the Courts and Tribunals of the city of Malaga. This contract constitutes the full and complete expression of the agreement between Salome Gomez Baena and the user, and replaces all previous agreements, commitments, statements or agreements, both written and oral, that have previously existed between them.
All the dwellings managed by Waterfrontmalaga are duly registered in the Tourism Register of Andalusia and strictly comply with the norms established in Decree 28/2016, of February 2, of the houses for tourist purposes and of modification of Decree 194/2010, of April 20, of tourist apartment establishments.
